Privacy Policy

The Collateral Lender, Inc., a California Corporation, doing business as (“dba”) CollateralLender.com also dba, Maxferd Jewelry & Loan (collectively, “COMPANY”) respects your privacy and will do its best to earn and keep your trust. This Privacy Policy identifies how we collect, use and protect the personal information you provide to us when you visit the Maxferd.com and other COMPANY branded URLs (“Websites”). COMPANY will request some information from you and automatically collect information about your use of the COMPANY Websites and the COMPANY Service (both as defined in the COMPANY Terms of Use). Further, COMPANY will request information from third party services if such services are activated via COMPANY. This policy (the “COMPANY Privacy Policy”) describes our online privacy practices and what personal information we may collect from you and what we will and will not do with that information.

COMPANY WILL NEVER DISCLOSE THE PERSONAL INFORMATION OF INDIVIDUALS OR ENTITIES WHO HAVE SOLD PRODUCTS OR GIVEN PRODUCTS (AS COLLATERAL) TO COMPANY (subject to provision 2(ii) below).

1. How We Collect and Use Personal Information

When you register with the COMPANY or use the COMPANY Websites, we may ask you for certain personal information, including, but not limited to, email address, postal address, age, gender, residence, date of birth and password. In addition, when you use the COMPANY Websites, we will automatically receive information about your use of the service and website including information such as media that you access, queries you make, date and time of your request, your Internet protocol address, performance of your network and computer, your browser type, language and identifying information, your operating system and application version.

(i) To help improve COMPANY Websites and COMPANY Products and Services to make your personal experience more enjoyable;

2. Sharing Information with Others

Unless you give us your explicit approval and except as outlined in Section 1 above and except with respect to, COMPANY affiliates (being other companies controlled by or under common control with us) and registered Vendor partners, we will only share your personal information for the purposes set forth under Section 1 (i) to (ix) above or as is necessary to:

COMPANY is not responsible for the privacy practices or the content of other websites that may be linked to COMPANY Websites.

COMPANY maintains reasonable security procedures and practices appropriate to the nature of the information, to protect the personal information from unauthorized access, destruction, use, modification, or disclosure, but we make no assurances about our ability to prevent any such access, destruction, use, modification, or disclosure.

4. Children’s Personal Information

The COMPANY Websites are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age you should not use the COMPANY Websites and under no circumstances should you provide personal information to us. COMPANY Websites’ web servers automatically collect information about a visitor’s IP address, browser type and referrer by reading this information from your browser. This information is collected in a database and used to help us recognize you each time you return to our Websites. It is also used in an aggregated anonymous manner – in our internal analysis of traffic patterns within our Websites. This information is automatically logged by most websites.

We may also store information about you using cookies (files which are sent by us to your computer or other access device). We do this to help improve the user experience of the website and to utilize certain information to assist us in better understanding your preferences. You grant COMPANY a license to use the materials (e.g, photos, tips, reviews and other information) you post to the COMPANY Websites (to the extent possible). By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the COMPANY Websites, you are granting COMPANY, its affiliates, officers, directors, employees, consultants, agents and representatives a license to use User Content in connection with the operation of the Internet business (e.g., blog, social media outlets, and consumer sites such as Facebook, Twitter, Pinterest, Bizrate, Yelp, etc.) of COMPANY, its affiliates, officers, directors, employees, consultants, agents and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that COMPANY may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the COMPANY Websites, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content. You shall obtain consent from your photographer before posting any photos and shall provide any necessary photo credit.

COMPANY reserves the right to make changes to this COMPANY Privacy Policy in its sole discretion without notice to you. We encourage you to review the Privacy Policy on a regular basis.
